Texas House of Representatives Passes Bill Making TSA Groping a Felony

Responding to outrage by citizens over invasive searches and groping of children by airport security, the Texas House of Representatives just passed a bill that would make the offensive searches a felony. The representatives aren't kidding around either; the language is very specific. It says that any airport screening that "touches the anus, sexual organ, buttocks, or breast of another person including through the clothing, or touches the other person in a manner that would be offensive to a reasonable person" will constitute sexual harassment, which is a crime.

MSNBC reports that the bill's author, Republican David Simpson, said: "Indecent groping searches when innocent travelers are seeking access to airports and public buildings would be outlawed under this bill....this has to do with dignity and travel, and prohibiting indecent, groping searches." The bill passed quickly and there was applause in the gallery after it passed. Now the bill goes to the Senate. If it passes there, it will go to Governor Rick Perry for signature.

If the state of Texas passes this bill, it will be preempted by federal law. However, it would allow a case to be filed so that the TSA searches could become the subject of a federal lawsuit and could possibly be deemed to be unconstitutional. Several other states have similar bills pending, after incidents such as the one where a child was invasively searched by a TSA agent, and when former Miss USA Susie Castillo said she was "molested" by a pat-down at D/FW Airport.

We do hope Representative Simpson isn't planning on flying any time soon.
